WMP Privacy Policy

WearMe Pro, LLC (“WMP,” “WMP Eyewear,” “we,” “our,” or “us”) is committed to maintaining robust privacy protections for our users. This Privacy Policy describes how WMP collects, uses, and shares your information when you use our website, mobile experiences, and customer service platforms (collectively, the “Platforms”). By accessing or using our Platforms, you acknowledge and accept the Terms of this Privacy Policy.

Scope

This Privacy Policy applies to individuals who access or use WMP’s websites, mobile experiences, and customer service platforms; customers who purchase eyewear or related products, including prescription eyewear; individuals who interact with WMP through marketing, advertising, or customer support channels; and service providers, partners, and other third parties acting on WMP’s behalf in connection with the Platforms.

Updates to This Policy

We may update this Privacy Policy based on evolving laws, regulations, or industry practices. We will post changes to this page and encourage you to review it periodically. If changes are significant, we will take appropriate measures to inform you. If you do not agree with any updates, you should discontinue use of our Platforms.

Children’s Privacy

You must be at least 16 years old to use our Platforms. Our Platforms are not directed to children under 13 (U.S. COPPA and Canada PIPEDA) or under 16 (EU GDPR). We do not knowingly collect personal data from children. If we learn that we have inadvertently collected such data, we will delete it.

Information We Collect

WMP collects information from and about individuals who interact with our Platforms, including customers, website visitors, and individuals who communicate with us through customer support or marketing channels. The categories of information we collect include:

  • Personal Identifiers and Commercial Information: Such information may include your name, billing and shipping address, email address, telephone number, payment information, order history, account credentials, and records of products purchased or considered.

  • Prescription and Order-Related Information: If you purchase prescription eyewear, we collect optical prescription information that you provide to us. This information is considered sensitive personal data and is collected solely to fulfill your order, verify accuracy, and provide customer support related to your eyewear.

  • Customer Communications: We collect information you provide when you contact us through live chat, email, phone, or other customer service channels, including communications stored and processed through our customer support platform.

  • Marketing and Interaction Data: We collect information related to your interactions with our marketing communications, including email and SMS engagement, advertising impressions, and conversions.

  • Technical and Usage Data: When you access or use our Platforms, we automatically collect certain technical information, including IP address, device identifiers, browser type, operating system, time zone, referral URLs, pages viewed, and browsing behavior. This information is collected through cookies, pixels, log files, and similar tracking technologies, as set forth in the Cookies Policy below.

Where personal information is required to enter into a contract or complete a purchase, failure to provide such information may prevent us from providing the requested products or services.

How We Collect Information

We collect information:

  • Directly from you when you place orders, create an account, subscribe to marketing communications, or contact customer support;

  • Automatically through cookies and similar technologies when you interact with our Platforms; and

  • From third-party service providers and analytics or advertising partners that support our business operations.

How We Use Information

We collect and use personal information for the following business and commercial purposes:

  • To process transactions, fulfill and deliver orders, and verify prescription accuracy;

  • To process payments and prevent fraud;

  • To operate, maintain, secure, and improve our Platforms;

  • To provide customer support, respond to inquiries, and manage communications;

  • To personalize your experience and recommend products;

  • To send transactional and marketing communications, subject to your consent and opt-out rights;

  • To conduct analytics, measure advertising performance, and retarget products or services;

  • To comply with legal, tax, accounting, and regulatory obligations; and

  • To protect the rights, property, and safety of WMP, our customers, and others.

We do not sell personal data for monetary value. We may “share” data for targeted advertising (cross-context behavioral advertising). You may opt out of this at any time (see Your Rights below).

Purpose and Legal Basis for Processing

We process personal information based on one or more of the following legal bases, as applicable:

  • Performance of a contract (e.g., fulfilling orders and providing services);

  • Legitimate business interests (e.g., improving Platforms, preventing fraud, and marketing our products);

  • Compliance with legal obligations; and

  • Your consent, where required by applicable law.

Third-Party Service Providers

We engage third-party service providers to perform functions on our behalf, including payment processing, order fulfillment, shipping, analytics, advertising, marketing communications, and customer support. These service providers are permitted to process personal information only as necessary to provide services to WMP and are contractually required to implement reasonable security measures and comply with applicable data protection laws.

WMP does not collect medical information subject to the Health Insurance Portability and Accountability Act (HIPAA), and third-party service providers are not acting as HIPAA business associates in connection with the Platforms.

Chat & Customer Support Data (Gorgias)

When you interact with us via live chat, email, or phone, your conversations and related personal information may be stored in Gorgias, our customer support platform. This data helps us:

  • Track your requests and order history,

  • Improve customer service quality, and

  • Train our support team.

Gorgias processes your data only as necessary to provide these services. For more details, see Gorgias’ Privacy Policy.


We may use automated tools, including artificial intelligence, to assist in customer service communications.

Do Not Track

Some browsers send “Do Not Track” signals. We do not currently respond to these signals.

Data Retention

We retain customer order data as long as necessary to comply with tax, accounting, and legal obligations. Marketing data is retained until you withdraw consent.

Financial Incentives Disclosure

From time to time, we may offer discounts, rewards, or other benefits in exchange for providing personal information (e.g., email/SMS opt-ins). These may be considered “financial incentives” under certain privacy laws. Participation is voluntary, and you may withdraw at any time.

Your Rights (CCPA/CPRA, GDPR, PIPEDA)

Depending on your location, you may have certain rights regarding your personal information under applicable data protection laws, including U.S. state privacy laws, Canadian privacy laws (PIPEDA) and the General Data Protection Regulation (GDPR). Subject to applicable exceptions and limitations, these rights may include:

  • Right to Access: Request a copy of your personal data.

  • Right to Delete: Request deletion of your personal data, subject to exceptions.

  • Right to Correct: Request correction of inaccurate or incomplete data.

  • Right to Opt-Out: Opt out of sharing data for targeted advertising.

  • Right to Data Portability: Request your data in a usable format.

  • Right to Withdraw Consent: Opt out of marketing at any time or withdraw consent to WMP’s collection of your information.

  • Right to Object or Restrict Processing (GDPR) – For individuals in the European Economic Area or United Kingdom, the right to object to or request restriction of certain processing activities based on legitimate interests or other legal grounds. 

  • Right to Lodge a Complaint (GDPR) – If you are located in the European Economic Area or the United Kingdom and believe that our processing of your personal data violates applicable data protection laws, you have the right to lodge a complaint with a supervisory authority. You may do so with the data protection authority in the EU Member State or UK jurisdiction of your habitual residence, place of work, or where the alleged infringement occurred. We encourage you to contact us first so we may address your concerns directly.

  • Right to Challenge Compliance (PIPEDA)

To exercise these rights: Contact us at legal@wmpeyewear.com. Only you or an authorized agent may make such a request. We may take reasonable steps to verify your identity before responding to a request, as permitted or required by law.

We will respond to verified requests within the timeframes required by applicable law and will not discriminate against you for exercising your privacy rights.

Security

We implement reasonable administrative, technical, and organizational safeguards and PCI-DSS standards to secure your data. Sensitive data (credit cards) is encrypted (SSL, AES-256). No system is 100% secure, but we take reasonable measures to protect your information.

Accessibility

Use of AI Tools

We use certain AI-powered tools and automated systems to enhance your experience on our website, improve customer support, assist with order-related questions, and help us optimize our services. These tools may process the information you provide through our website or support channels in order to generate responses or improve site performance. The AI tools we use operate in accordance with our Privacy Policy, and any data processed through them is handled securely and only for the purpose of providing or improving our services. WMP does not engage in automated decision-making or profiling that produces legal or similarly significant effects within the meaning of Article 22 of the GDPR.

This Cookies Policy explains how WMP uses cookies, pixels, and similar tracking technologies on the Platforms. It describes the types of cookies WMP uses, the purposes for which it uses them, and the choices available to you regarding their use.

This Cookies Policy applies to users in the United States, Canada, and the European Union/European Economic Area (“EU/EEA”), and is designed to comply with applicable privacy and data protection laws, including the GDPR, the California Consumer Privacy Act, as amended by the CPRA (CCPA/CPRA), other applicable U.S. state privacy laws, and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

Cookies are small text files placed on your device when you visit a website. WMP also uses similar technologies, such as pixels/tags (e.g., tracking pixels for advertising and analytics), SDKs, local storage and session storage, and server-side tracking tools (collectively, “Cookies”).

  • Performance/Analytics Cookies: These cookies collect information about how users interact with the Platforms to help WMP understand usage patterns and improve performance.

    • Their purposes include, but are not limited to: 

      • Measuring traffic and engagement,

      • Understanding navigation paths, and

      • Improving Site functionality and design.

  • Targeting/Advertising Cookies: These cookies are used to deliver advertising that is relevant to your interests and to measure the effectiveness of marketing campaigns. 

    • Their purposes include, but are not limited to:

      • Displaying personalized or interest-based ads, 

      • Retargeting users who have abandoned carts, and 

      • Measuring advertising performance and attribution. 

Subject to user consent where required by law, WMP may use the following third-party tools and service providers: Google Analytics, Meta (Facebook) Pixel, TikTok Pixel, Snapchat Pixel, Pinterest Tag, Triple Whale, and Klaviyo and Attentive (email and SMS marketing analytics and attribution). These providers may collect information such as IP addresses, device identifiers, browsing behavior, and interactions with advertisements, in accordance with their own privacy policies.

Some of our third-party service providers may process data outside your country of residence, including in the United States. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses, adequacy decisions, and other lawful transfer mechanisms.

EU/EEA Users

For visitors located in the EU or EEA, WMP operates on a prior opt-in basis:

  • Non-essential cookies and tracking technologies are not loaded unless and until you provide explicit consent through our cookie banner.

  • You may withdraw or modify your consent at any time by adjusting your cookie preferences via the cookie settings link available on the Platforms.

  • Consent is granular, allowing you to accept or reject specific categories of cookies.

For California residents, WMP implements a footer-based privacy preferences model as follows:

Canada (PIPEDA)

For visitors located in Canada, WMP obtains meaningful consent for the use of non-essential cookies, consistent with PIPEDA requirements. Consent is obtained through our cookie banner. You may change or withdraw your consent at any time through cookie preference settings. Implied consent is not relied upon for advertising or cross-context behavioral tracking.

You may manage your cookie preferences in the following ways:

  • Through the cookie consent banner displayed when you first visit the Platforms; 

  • By using the “Your Privacy Choices” link available on the Platforms;

  • By adjusting browser settings to block or delete cookies (note that disabling strictly necessary cookies may impair Platform functionality).

Withdrawing consent will not affect the lawfulness of cookies used prior to withdrawal.

Marketing Opt-Outs

You may opt out of:

  • Email marketing by clicking “unsubscribe” in any message.

  • SMS marketing by replying STOP to any text.

  • Direct mail or third-party marketing by contacting legal@wmpeyewear.com with your full name, email, and mailing address.

Please allow 5 business days for email opt-outs and up to 8 weeks for postal mail changes.
