INTRODUCTION
Thank you for visiting WearMe Pro, LLC doing business as WMP Eyewear (“WMP Eyewear,” “Company,” “we,” “us,” or “our”). The following Terms and Conditions (“Terms” or “Agreement”) govern your access, interaction, and use of all features, functionalities, services, content, and offerings presented, facilitated, or offered through our official website, sub-domains, affiliated platforms, and mobile experiences (collectively, the “Platform”).
Our Platform is designed to provide you with an in-depth understanding of our products, offerings, and operations, and to facilitate your interaction, purchase, and engagement with us. By accessing or using the Platform, creating an account, or purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms. You confirm that you possess the legal authority to enter into this Agreement and that you will abide by all of its stipulations.
If you disagree with or cannot comply with these Terms, you must refrain from using the Platform or ordering the Services. Continued use signifies your informed consent and agreement to these Terms and any future revisions.
In addition to these Terms, you are bound by our Privacy Policy, which explains our practices concerning the collection, use, and sharing of your personal information. By agreeing to these Terms, you also consent to the data practices stated in our Privacy Policy.
We reserve the right to modify these Terms at any time. Changes are effective upon posting unless otherwise stated. It remains your responsibility to periodically review these Terms for updates or changes. Your continued use of our Platform after any modification signifies your acceptance of the amended Terms.
ELIGIBILITY
You must be at least the age of majority in your jurisdiction to create an account or make a purchase. By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are the age of majority in your state or jurisdiction of residence and you have given us your consent to allow any of your minor dependents to use this site. The Platform is not intended for individuals under the age at which parental consent is required under applicable law, and we do not knowingly collect personal information from persons under this age. If we become aware that a user under the age at which parental consent is required under applicable law has provided personal information or is using our services, we will remove such information and terminate the account pursuant to our Privacy Policy.
COMMUNICATIONS
By using the Platform or providing your contact information, you consent to receive electronic communications from us , including transactional, service-related, and (where you opt in) marketing messages via email or SMS/MMS. Standard message and data rates may apply. We do not share SMS opt-in data or consent status with third parties for marketing. You may opt out of marketing communications at any time. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message, or email legal@wmpeyewear.com with your number. You may receive a final confirmation. Withdrawal of consent does not affect transactional or legally required communications.
For Canadian residents, marketing communications are sent in compliance with Canada’s Anti-Spam Legislation (CASL) and require express or implied consent as defined by law.
For EEA/UK residents, marketing communications are sent only with prior consent in accordance with General Data Protection Regulation (“GDPR”) and ePrivacy rules, and you may withdraw consent at any time without affecting prior lawful processing.
We may use automated tools, including artificial intelligence, to assist in customer service and other communications
Any comments, materials, suggestions, reviews, or feedback you send to us (“Received Materials”) may be treated as non-confidential and non-proprietary to the extent permitted by applicable law. We may use, reproduce, modify, publish, translate, create derivative works from, and distribute Received Materials without obligation to you. Nothing in these Terms is intended to waive or limit any non-waivable moral rights or data protection rights you may have under applicable law, including GDPR.
STATE-SPECIFIC PRIVACY RIGHTS
State consumer privacy laws may provide their residents with additional rights regarding WMP Eyewear’s use of their personal information. California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

Confirm whether WMP Eyewear processes their personal information;

Access and delete certain personal information;

Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah);

Opt-out of personal data processing for targeted advertising (excluding Iowa); sales; or profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah); and

Either limit (opt-out of) or require consent to process sensitive personal data.
Nevada provides its residents with a limited right to opt-out of certain personal information sales. However, please know WMP Eyewear does not currently sell data triggering that statute's opt-out requirements.
The exact scope of these rights may vary by state. To exercise any of these rights please contact WMP Eyewear at legal@wmpeyewear.com. WMP Eyewear is committed to honoring these rights and will not discriminate against any consumer for exercising their privacy rights.
ACCOUNT CREATION
Certain features on the Platform require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use or breach of security.
Use a strong password and change it regularly.
You may not use another person’s account without permission or sell/transfer your account. Your account is personal and may not be shared or transferred.
You are responsible for all actions taken in connection with your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms or applicable law, or pose a risk to the Platform or other users.
USER GUIDELINES
You agree to use the Platform only for lawful, personal, and non-commercial purposes. You may not:

Use the Platform or products for any illegal or unauthorized purpose;

Infringe the intellectual property or privacy rights of others;

Interfere with or disrupt the security or operation of the Platform;

Use the Platform or products in connection with any commercial endeavors;

Attempt to gain unauthorized access to any systems or data; or

Misrepresent your identity or affiliation.
We reserve the right to refuse service to anyone, at any time, for any lawful reason.
TERMS OF SALE
The following terms apply to your purchase of products offered on the Platform (“Products” or “Services”).
All descriptions, images, pricing, and availability are subject to change without notice. We do not guarantee that Product descriptions or other content are accurate, complete, or current.
WMP Eyewear may change prices and available Products at any time without notice. We reserve the right at any time to modify, alter or discontinue the Products or Services without notice at any time. Quantities may be limited; stock is not guaranteed. If a Product’s correct price is higher than listed, we may contact you to confirm or cancel; if lower, we may refund the difference. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Products or Services.
An order constitutes an offer to purchase. We accept orders only upon shipment confirmation. We may refuse, cancel, or limit orders for any reason, including suspected fraud or inventory limitations. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.
We may refuse or limit orders and quantities.
If you are a consumer located in the EU, you may have a statutory right to withdraw from a distance purchase within fourteen (14) days of receipt of the goods, without giving any reason, except for products that are custom-made or clearly personalized (including prescription eyewear), which are exempt under applicable law.
Nothing in these Terms limits your mandatory consumer rights under applicable EU or UK law.
PAYMENT
You authorize us and our payment processor to charge your payment method for purchases, including applicable taxes and shipping costs. You are responsible for ensuring that payment information is accurate and current. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. We may cancel or reverse transactions that violate these Terms or applicable law.
GIFT CARDS & STORE CREDIT
Physical or electronic gift cards, store credits, and promotional credits (together, “Credits”) are redeemable only toward eligible purchases on the Platform and, if applicable, in Company retail locations. Credits cannot be redeemed for cash (except where required by law), used to buy other gift cards, or applied to past purchases.
Items purchased with a gift card will be refunded back to that gift card. Store credit may be issued for returns as stated in our current Return Policy (see Help Center).
Gift cards do not expire. Store credit and promotional credits may carry expiration dates as stated at issuance or in promotional terms.
We are not responsible for lost, stolen, or unauthorized use of any Credits. Protect them like cash.
Credits may not be resold or transferred for value and are void if copied, sold, or exchanged in violation of these Terms.
SHIPPING & DELIVERY
Shipping timelines are estimates only. Title and risk of loss pass to you upon delivery to the carrier, except where prohibited by applicable law. For consumers in jurisdictions where risk of loss remains with the seller until delivery to the consumer (including the EU, UK, and certain Canadian provinces), risk of loss transfers upon delivery to you. Returns and refunds are governed by our Return Policy available in the Help Center and incorporated by reference.
INTELLECTUAL PROPERTY
All Platform content and Products are owned by WMP Eyewear or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or exploit any portion of the Platform or Products without our prior written consent.
All content, trademarks, logos, and service marks displayed on the Platforms are owned by or licensed to WMP Eyewear and are protected by copyright and other intellectual property laws. Your use of the Platforms does not grant you ownership of any content, data, or materials you may access on or through the platform.
USER CONTENT
Any content you submit, including reviews, images, or feedback ("User Content"), may be used by WMP Eyewear on a non-confidential basis. You grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such content for business and promotional purposes, subject to applicable law.
INTERNATIONAL DATA TRANSFERS
If you access the Platform from outside the United States, your personal information may be transferred to, processed, and stored in the United States or other jurisdictions. Where required by GDPR or other applicable law, we rely on approved transfer mechanisms such as Standard Contractual Clauses or equivalent safeguards.
DISCLAIMER OF WARRANTIES
YOU ACKNOWLEDGE THAT YOU ARE USING THE PLATFORMS AND PRODUCTS AT YOUR OWN RISK. THE PLATFORMS AND PRODUCTS ARE PROVIDED "AS IS," AND TO THE FULL EXTENT PERMITTED BY APPLICABLE LAW, WMP EYEWEAR, ITS AFFILIATES, AND ITS THIRD PARTY SERVICE PROVIDERS HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF ACCURACY, COMPLETENESS OR RELIABILITY, TITLE, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM. WMP EYEWEAR, ITS AFFILIATES, AND ITS THIRD-PARTY SERVICE PROVIDERS DO NOT REPRESENT OR WARRANT THAT ACCESS TO THE PLATFORMS WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS, OR LOSS OR SECURITY BREACH OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED THROUGH ACCESS TO OR USE OF WMPEYEWEAR.COM.
WMP EYEWEAR MAKES NO REPRESENTATION THAT THE PLATFORMS, SERVICES, OR PRODUCTS OFFERED THROUGH THE PLATFORMS ARE APPROPRIATE, AVAILABLE, OR LEGAL IN ANY PARTICULAR LOCATION. THOSE WHO CHOOSE TO ACCESS THE PLATFORMS, SERVICES, AND PRODUCTS OFFERED THROUGH THE PLATFORMS DO SO ON THEIR OWN INITIATIVE AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAWS, IF AND TO THE EXTENT LOCAL LAWS ARE APPLICABLE.
NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY CONSUMER RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW, INCLUDING STATUTORY WARRANTIES, CONDITIONS, OR GUARANTEES UNDER CANADIAN CONSUMER PROTECTION LAWS OR EU/UK CONSUMER LAW.
LIMITATION OF LIABILITY
WMP EYEWEAR, ITS AFFILIATES, AND ITS THIRD-PARTY SERVICE PROVIDERS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THESE TERMS, THE PROVISION OF SERVICES HEREUNDER, THE SALE OR PURCHASE OF ANY PRODUCTS ORDERED THROUGH THE PLATFORMS, YOUR ACCESS TO OR INABILITY TO ACCESS THE PLATFORMS, INCLUDING FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE PLATFORMS, YOUR USE OF OR RELIANCE ON THE PLATFORMS OR MATERIALS AVAILABLE THROUGH THIRD PARTY SITES LINKED TO THE PLATFORMS, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE TOTAL AMOUNT PAID BY YOU TO WMP EYEWEAR FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless WMP Eyewear, its subsidiaries, affiliates, officers, directors, employees, agents, licensors, consultants, suppliers, and any third-party website providers from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your (or anyone using your account’s) breach of these Terms or your use of our Platform, Services, or Products. We may assume the exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate. This provision survives termination.
PROMOTION LIMITATIONS
Unless otherwise specified: product prices may already reflect discounts; offers are limited to stock on hand (no rain checks); not valid on prior purchases, gift cards, gift certificates, taxes, or shipping/processing; customer must pay applicable sales tax; offers may not be combined with any other sale, promotion, discount, code, bundle, coupon and/or offer; promotions have no cash value and cannot be sold or bartered; returns of any portion of a promotional purchase may require forfeiture of the promotional value or an amount equal to the offer; only one promotional credit/reward may be used per order unless expressly stated; promotional credits are single-use and any unused amount is forfeited; WMP Eyewear may substitute a reward of equal or greater value or void rewards points/credits in its sole discretion; WMP Eyewear may end or modify any promotion at any time without notice; additional restrictions may apply; offers apply only to the United States unless otherwise noted.
DISPUTE RESOLUTION
Before taking formal action, you must email legal@wmpeyewear.com with a written description of the dispute and your contact information and allow sixty (60) days for us to reach an amicable resolution. Include your name, address, and the email(s) associated with your account(s).
If unresolved, the parties agree to endeavor to settle the dispute through mediation with a mutually agreed neutral mediator, sharing costs equally.
If mediation is unsuccessful, either party may initiate binding arbitration in accordance with the rules of the American Arbitration Association administered by a recognized arbitral body mutually agreed upon by the parties. The arbitrator’s judgment may be entered in any court with jurisdiction. Each party bears its own costs and shares arbitrator costs unless otherwise ordered.
For consumers residing in the EU or Canada, mandatory arbitration and class action waivers apply only to the extent permitted by applicable law. You may also have the right to bring claims before local courts or consumer protection authorities.
Class Action Waiver / Jury Waiver: TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. IF A DISPUTE PROCEEDS IN COURT, THE PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.
YOU CAN REJECT THE AGREEMENT TO ARBITRATE BY EMAILING AN OPT-OUT NOTICE TO LEGAL@WMPEYEWEAR.COM WITHIN THIRTY (30) DAYS AFTER THE DATE YOU FIRST ACCEPT THESE TERMS.
Except as required by law, neither a party nor the arbitrator may disclose the existence, content, or result of any arbitration without prior written consent of both parties, unless to protect or pursue a legal right.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles. Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the state or federal courts located in Arizona, and each party consents to jurisdiction and venue in such courts. If you access the Platform from outside the United States, you are responsible for compliance with local laws.
AMENDMENTS
We may modify, alter, or update these Terms at any time. Modifications are effective upon posting to the Platform (or as otherwise stated). While we may endeavor to notify users of significant changes, you are responsible for reviewing the Terms periodically. Your continued use following posting of revisions means you accept the changes. For substantial changes that materially diminish your rights or increase your responsibilities, we will provide more prominent notice (e.g., email or a prominent Platform notice) at least 30 days before effectiveness where feasible.
CONTENT DISCLAIMER
We are not responsible if information made available on the Platforms is not accurate, complete, or current. The material on the Platforms is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on the Platforms is at your own risk.
The Platforms may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of the Platforms at any time, but we have no obligation to update any information on the Platforms. You agree that it is your responsibility to monitor changes to the Platforms.
THIRD-PARTY LINKS
The Platform may contain links to third-party websites, services, or resources. These links are provided for convenience only and do not constitute endorsement. We do not control and are not responsible for third-party content, availability, or security. Accessing any third-party websites is at your own risk. We may terminate links at any time.
FORCE MAJEURE
We are not responsible for any delay or failure to perform due to events beyond our reasonable control, including acts of God; natural disasters; war; civil disturbances; government actions; embargoes or blockades; national or regional emergencies; labor disputes (excluding our own employees); utility failures; telecommunications disruptions; epidemics/pandemics; or other extraordinary events. If a force majeure event continues for more than 60 consecutive days, either party may terminate on 10 days’ written notice.
ASSIGNMENT
You may not assign, delegate, subcontract, or otherwise transfer your rights or obligations under these Terms without our prior written consent; any attempted transfer without consent is void. We may assign or transfer our rights and obligations (e.g., by merger, acquisition, reorganization, or sale of assets) without notice. These Terms bind and benefit successors and permitted assigns.
SEVERABILITY
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions remain in full force. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
ENTIRE AGREEMENT
These Terms (including policies incorporated by reference, such as our Privacy Policy and Help Center Return Policy) constitute the entire agreement between you and WMP Eyewear regarding the Platform and supersede all prior or contemporaneous communications and proposals (oral or written). Any modification must be in writing and signed by an authorized WMP Eyewear representative. Provisions that by their nature should survive termination do survive (e.g., IP, indemnification, dispute resolution, governing law).

FLORIDA LAW (MOBILE MESSAGING COMPLIANCE)
We endeavor to comply with the Florida Telemarketing Act and Florida Do Not Call Act as applicable to Florida residents. For compliance purposes, you agree we may assume you are a Florida resident if, at opt-in, (1) your shipping address is in Florida or (2) your opt-in phone number uses a Florida area code, unless you notify us otherwise in writing. Messages sent in direct response to your requests (e.g., keyword replies, opt-in confirmations, HELP/STOP responses, shipping notifications) are not treated as “telephonic sales calls” for purposes of Florida Statutes Section 501 to the extent the law is otherwise relevant and applicable.
PRESCRIPTION DISCLAIMER & PRESCRIPTION ORDER POLICY
WMP Eyewear does not provide medical advice or eye examinations. Prescription eyewear is manufactured based solely on the information you provide. You are responsible for ensuring the accuracy and validity of your prescription and pupillary distance.
Custom prescription lenses are non-refundable once production begins, except as expressly stated in our remake policy. We are not liable for issues arising from inaccurate or expired prescriptions, changes in vision, or misuse of Products.
NO INSURANCE COVERAGE
WMP Eyewear is not an insurance company, insurance administrator, broker, or claims processor, and does not provide insurance-related services of any kind. WMP Eyewear is not contracted with, affiliated with, or participating in any private insurance plans or any federal or state healthcare programs, including but not limited to Medicare or Medicaid.
All products sold by WMP Eyewear, including prescription sunglasses and any related services, are offered exclusively on a direct-to-consumer, cash-pay basis. WMP Eyewear does not accept insurance, does not submit claims to insurance carriers, and does not verify, process, or otherwise handle insurance benefits on your behalf.
By purchasing products from WMP Eyewear, you acknowledge and agree that you are solely responsible for payment of all charges associated with your purchase at the time of sale. Any amounts paid to WMP Eyewear are not eligible for direct insurance reimbursement through WMP Eyewear. If you choose to seek reimbursement from your insurance provider independently, you do so at your own discretion and risk, and WMP Eyewear makes no representations or guarantees regarding coverage, reimbursement eligibility, or claim approval.
You agree not to submit, or cause to be submitted, any claims to an insurance provider that inaccurately represent WMP Eyewear as an in-network or contracted provider, or that otherwise mischaracterize the nature of the products or services provided. You acknowledge that you bear sole responsibility and liability for any improper or inaccurate submission of claims to an insurance carrier or healthcare program.
