INTRODUCTION
Thank you for choosing to visit WearMePro, Inc., doing business as “WMP Eyewear” (herein referred to as “Company,” “we,” “us,” “our,” or “WMP Eyewear”). The following Terms and Conditions (“Terms” or “Agreement”) delineate the governing framework of our users’ (“you,” “your,” “user,” or “customer”) access, interaction, and use of all features, functionalities, services, content, and offerings presented, facilitated, or offered through our official website, sub-domains, affiliated platforms, and mobile experiences (collectively, the “Platform”).
Our Platform is designed to provide you with an in-depth understanding of our products, offerings, and operations, and to facilitate your interaction, purchase, and engagement with us. By accessing, browsing, registering, or engaging in any form of interaction or transaction on or through our Platform, you willingly and expressly acknowledge, accept, and agree to be bound, without limitation or qualification, by these Terms. You confirm that you possess the legal authority to enter into this Agreement and that you will abide by all of its stipulations.
Please read these Terms in their entirety. If you disagree with or cannot comply with these Terms, you must refrain from using the Platform. Continued use signifies your informed consent and agreement to these Terms and any future revisions.
In addition to these Terms, you are bound by our Privacy Policy, which explains our practices concerning the collection, use, and sharing of your personal information. By agreeing to these Terms, you also consent to the data practices stated in our Privacy Policy.
We reserve the right to modify, amend, replace, or terminate these Terms at any time, at our sole discretion. It remains your responsibility to periodically review these Terms for updates or changes. Your continued use of our Platform after any modification signifies your acceptance of the amended Terms.
ELIGIBILITY
To access or use the Platform, you must be at least 18 years of age. By agreeing to these Terms, you represent and warrant that you are at least 18 and have the full legal capacity to enter into binding agreements. The Platform is not intended for individuals under 18, and we do not knowingly collect personal information from persons under this age. If we become aware that a user under 18 has provided personal information or is using our services, we will remove such information and terminate the account. Parents or guardians are advised to supervise minors’ online activities and consider parental control tools.
COMMUNICATIONS
When you visit the Platform, create an account, make a purchase, or contact us, you consent to receive communications from us electronically. We may communicate via email, SMS/MMS (subject to your opt-in), customer support chat, or by posting notices on the Platform. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
We may use automated tools, including artificial intelligence, to assist in customer service communications
Any comments, materials, suggestions, reviews, or feedback you send to us (“Received Materials”) may be treated as non-confidential and non-proprietary. We may use, reproduce, modify, publish, translate, create derivative works from, and distribute Received Materials without obligation to you.
ACCOUNT CREATION
Registration Requirements: Certain features require you to register and create an account, providing accurate and current information (e.g., name, email, password). You are responsible for keeping information accurate and up-to-date.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use or breach of security.
Password Management: Use a strong password and change it regularly.
Account Integrity: You may not use another person’s account without permission or sell/transfer your account.
Account Activity: You are responsible for all actions taken in connection with your account.
Account Termination: We may suspend or terminate accounts that provide inaccurate information or violate these Terms or applicable law. Your account is personal and may not be shared or transferred.
USER GUIDELINES
Acceptable Use: Use the Platform lawfully and responsibly.
Prohibited Activities include (without limitation):
• Illegal Activities.
• Infringement of Rights (IP, privacy, or other rights).
• Disruption or undue burden on the Platform or connected networks.
• Unauthorized Access (hacking, password mining, etc.).
• Distribution of malicious code.
• Misrepresentation/impersonation.
• Unapproved commercial activities (advertising/soliciting) unless authorized.
Content Standards: Content you make available must comply with law and must not be infringing, defamatory, obscene, violent, hateful, or misleading.
Reporting & Enforcement: Report violations promptly. We may monitor, remove content, and suspend/terminate accounts at our discretion.
TERMS OF SALE
The following terms apply to your purchase of products offered on the Platform, whether by way of a membership, “add-on” product, or otherwise (“Products”).
Product Descriptions: We strive for accuracy but content may sometimes be incorrect, incomplete, or outdated (including price, description, availability). We reserve the right to correct errors (by changing information or informing you and allowing cancellation) and update Product information at any time.
Availability & Pricing: WMP Eyewear may change prices and available Products/memberships at any time. Quantities may be limited; stock is not guaranteed. If a Product’s correct price is higher than listed, we may contact you to confirm or cancel; if lower, we may refund the difference.
Purchasing Products: Your order is an offer to buy, which we accept only by shipping the Products ordered. Any confirmation you receive after placing an order is not acceptance and remains subject to correction prior to shipment.
Orders: We may refuse or limit orders and quantities and may limit memberships. For seasonal/annual memberships, WMP Eyewear makes no guarantees about style or color selections, which may vary.
Payment: You authorize us (and our payment processor) to charge your payment method for purchases, including recurring membership charges. Completion of payment is contingent on accurate information, authorization by your card issuer, and acceptance of payment. We may cancel a payment or prevent future payments for any reason (e.g., breach of law or Terms, fraud risk, excessive disputes, failure to provide requested information).
Taxes: Prices exclude customs duties, sales, use, VAT, excise, and other taxes. You are responsible for applicable taxes. We may charge taxes we believe we are required to collect.
Gift Certificates: Gift certificates will expire or decline in value, or not, in accordance with the laws of the purchaser’s location at the time of purchase (see “Gift Cards & Store Credit” for more).
GIFT CARDS & STORE CREDIT
Use: Physical or electronic gift cards, store credits, and promotional credits (together, “Credits”) are redeemable only toward eligible purchases on the Platform and, if applicable, in Company retail locations. Credits cannot be redeemed for cash (except where required by law), used to buy other gift cards, or applied to past purchases.
Returns: Items purchased with a gift card will be refunded back to that gift card. Store credit may be issued for returns as stated in our current Return Policy (see Help Center).
Expiration: Gift cards do not expire. Store credit and promotional credits may carry expiration dates as stated at issuance or in promotional terms.
Loss & Theft: We are not responsible for lost, stolen, or unauthorized use of any Credits. Protect them like cash.
Restrictions: Credits may not be resold or transferred for value and are void if copied, sold, or exchanged in violation of these Terms.
ORDERING AND PAYMENT
Order Placement: Add Products to cart and proceed to checkout, providing required billing, shipping, and contact details.
Order Confirmation: After placing an order, you will receive an acknowledgment email indicating receipt—not acceptance. We accept your order only when we send a shipment confirmation.
Price Discrepancies: If a discrepancy occurs, we may correct it. If the corrected amount is higher, we will seek confirmation; if lower, we will refund the difference.
Cancellations: We may refuse or cancel any orders, whether or not confirmed and/or charged. If we cancel after you have been charged, we will refund the original payment method.
SHIPPING & DELIVERY
Estimated Delivery: Delivery timeframes are estimates shown at checkout and in your order confirmation. Actual delivery is performed by third-party carriers and may be affected by carrier capacity, weather, customs, and other factors outside our control.
Transfer of Title & Risk: Title and risk of loss or damage transfer to you upon delivery of Products to the carrier. By purchasing Products for shipment, you authorize us to engage a carrier on your behalf. We may determine packaging and carrier selection and may ship items in multiple boxes/shipments.
Undeliverable/Delays: We are not liable for delays, damages, or losses during shipping that are beyond our control. Please review tracking updates provided by the carrier.
RETURNS & REFUNDS
Refer to Help Center: Return eligibility, methods, timelines, fees (if any), and exclusions are set forth in our current Return Policy available in the Help Center on our website. That Return Policy is incorporated by reference and may be updated from time to time.
Happy Returns Bar Confirmation: If you use a third-party return bar (e.g., Happy Returns), you must obtain and retain a return confirmation (digital or printed) at the time the item is surrendered. WMP Eyewear is not responsible for third-party locations that fail to scan or accept items. Returns are considered received only upon issuance of a valid confirmation by the return bar or our receipt scan at a warehouse, as applicable.
Refund Method: Refunds (when applicable) are processed to the original payment method or as store credit pursuant to the Return Policy. Original shipping charges are typically non-refundable unless otherwise stated in the Help Center.
INTELLECTUAL PROPERTY
Ownership: All content presented or displayed on our Platform—including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software—is the sole property of WMP Eyewear or its content suppliers and is protected by international IP laws.
Use Restrictions: You may not reproduce, modify, distribute, transmit, display, publish, sell, license, create derivative works from, or use any content for commercial/public purposes without our prior written permission.
Trademarks: “WMP Eyewear,” the WMP Eyewear logo, and related names, logos, product and service names, designs, and slogans are trademarks of WMP Eyewear or its affiliates/licensors. All other marks are the property of their respective owners.
Infringement Claims: If you believe content on the Platform infringes your IP, please provide a detailed notice sufficient for evaluation and action where appropriate.
License Grant: Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for personal, non-commercial use.
Termination: Unauthorized use or breach of these Terms terminates the license.
USER CONTENT
Definition: “User Content” includes text, images, videos, artworks, ideas, queries, reviews, comments, suggestions, and other content you submit or make available on the Platform or directly to us.
License to Company: You grant WMP Eyewear a global, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, publish, perform, sell, transmit, modify, adapt, create derivative works from, and otherwise exploit your User Content in any media, including for promotional and commercial uses. You retain ownership subject to this license.
Moral Rights Waiver: You irrevocably waive any moral rights in your User Content to the extent permitted by law.
Personal Attributes: You consent to our use of your name, image, likeness, and biographical information in connection with User Content as permitted by law.
Your Responsibilities: You represent and warrant that you have all rights needed to grant the above license and that your User Content does not infringe or violate third-party rights or applicable law.
Company Discretion: We may remove, edit, or refuse any User Content at our sole discretion and have no obligation to keep it confidential, compensate you, or respond.
WARRANTIES AND DISCLAIMER
NO WARRANTIES. THE PLATFORM, SERVICES, AND PRODUCTS ARE PROVIDED “AS AVAILABLE” AND “AS IS,” WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND. WMP EYEWEAR DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WMP EYEWEAR DOES NOT WARRANT THAT PRODUCTS WILL BE IN STOCK, SAFE, DEFECT-FREE, OR CONFORM WITH ANY REPRESENTATIONS, OR THAT PRODUCTS WILL NOT BE LOST OR DAMAGED IN SHIPMENT.
YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. WMP EYEWEAR DOES NOT WARRANT THAT THE PLATFORM, SERVICES, OR EMAILS SENT TO YOU WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL CODE. WE MAKE NO PROMISE THAT THE PRODUCTS, PLATFORM, OR SERVICES WILL MEET YOUR REQUIREMENTS OR ACHIEVE PARTICULAR RESULTS. WE ARE NOT RESPONSIBLE FOR THIRD-PARTY CONTENT OR SERVICES OR LINKS TO THIRD-PARTY SITES. PACKAGING, LABELS, AND INSTRUCTIONS MAY CONTAIN MANUFACTURER DISCLAIMERS THAT APPLY TO PRODUCTS YOU PURCHASE.
NO RESPONSIBILITY FOR THIRD-PARTY MATERIALS. WE DO NOT WARRANT, ENDORSE, OR GUARANTEE ANY THIRD-PARTY PRODUCT OR SERVICE ADVERTISED OR OFFERED THROUGH THE PLATFORM OR ANY LINKED SITE. WE ARE NOT RESPONSIBLE FOR MONITORING TRANSACTIONS WITH THIRD PARTIES.
VARIATION OF RIGHTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES; SOME EXCLUSIONS MAY NOT APPLY TO YOU.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, WMP Eyewear, its affiliates, directors, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, goodwill, data) arising from or related to your access to or use of, or inability to access or use, the Platform; any unauthorized access to or use of our servers or personal information; or any interruption or cessation of services.
Maximal Liability: IN NO EVENT SHALL OUR CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO OUR PLATFORM, SERVICES, OR PRODUCTS EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Third-Party Links/Tools: Access is provided “as is” and “as available” without warranties or endorsement.
Acknowledgment: You acknowledge these limitations are fundamental elements of the bargain between you and us.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless WMP Eyewear, its subsidiaries, affiliates, officers, directors, employees, agents, licensors, consultants, suppliers, and any third-party website providers from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your (or anyone using your account’s) breach of these Terms or your use of our Platform, services, or Products. We may assume the exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate. This provision survives termination.
ERRORS AND OMISSIONS
Despite efforts to be accurate, information on the Platform or in communications may contain errors or omissions (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update information or cancel orders if information is inaccurate, without prior notice (including after an order is submitted). We do not commit to update information except as required by law. You are responsible for verifying information before relying on it.
MARKETING (SMS/MMS)
Enrollment: By opting into our SMS/MMS program, you agree to receive recurring automated marketing and informational texts to the number you provide. Consent is not a purchase condition. Message/data rates may apply. We do not share SMS opt-in data or consent status
with third parties for marketing. Carriers are not liable for delayed/undelivered messages.
Frequency: Message frequency varies by engagement, preferences, and our discretion.
User Opt-In: Enrollment may occur via online forms, checkboxes, or other clear opt-in methods. Some messages may be sent using automated technology. For help, reply HELP or email service@wmpeyewear.com.
User Opt-Out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message, or email service@wmpeyewear.com with your number. You may receive a final confirmation. We may decline to act on ambiguous phrasing to avoid unintended opt-outs.
Program Terms: Participation is subject to these Terms, our Mobile Terms (if separately posted), and our Privacy Policy. We may modify or terminate the program at any time.
PROMOTION LIMITATIONS
Unless otherwise specified: product prices may already reflect discounts; offers are limited to stock on hand (no rain checks); not valid on prior purchases, gift cards, gift certificates, taxes, or shipping/processing; customer must pay applicable sales tax; offers may not be combined with any other sale, promotion, discount, code, bundle, coupon and/or offer; promotions have no cash value and cannot be sold or bartered; returns of any portion of a promotional purchase may require forfeiture of the promotional value or an amount equal to the offer; only one promotional credit/reward may be used per order unless expressly stated; promotional credits are single-use and any unused amount is forfeited; WMP Eyewear may substitute a reward of equal or greater value or void rewards points/credits in its sole discretion; WMP Eyewear may end or modify any promotion at any time without notice; additional restrictions may apply; offers apply only to the United States unless otherwise noted.
FREE MYSTERY PAIR HALLOWEEN SALE
We love giving our customers extra fun and value during our special promotions! For the Halloween Free Pair, every qualifying order receives a Mystery Pair as a gift. These items are final sale and cannot be returned or exchanged. If you return all paid items, the Mystery Pair must also be returned, or its value ($25) will be deducted from your refund.
BUY 1 GET 1 FREE SALE
For our BOGO Anniversary Sale, the discount only applies when two qualifying items are added to your cart at checkout and will be applied automatically. The discount is applied to the lowest-priced item and is applied once per order only. We’re unable to apply the discount after an order is placed. Refunds for BOGO items are based on the discounted prices: returning both items results in a full refund, while returning just one item refunds only that item’s discounted price, and the item you keep remains at its discounted price. Exclusions: Custom Rx Lenses, Bundles & Accessories. Special exclusions: Degree Seven, Legacy, Genesis. Free items received through the BOGO promotion are also final sale.
DATA PRIVACY
Commitment to Privacy: We take privacy seriously and handle personal information in accordance with our Privacy Policy.
Collection: We may collect personal and non-personal data (e.g., name, email, address, payment info) as you interact with the Platform.
Use: We use data to operate and improve the Platform, process orders, respond to inquiries, personalize experiences, and communicate with you.
Privacy Policy: See our Privacy Policy for details (incorporated by reference). We may update our practices as described there.
YOUR DATA PRIVACY RIGHTS (GDPR/CCPA/CPRA & SIMILAR LAWS)
Depending on your jurisdiction, you may have rights to: (1) know/access categories and specific pieces of personal information collected/used/disclosed/shared; (2) delete certain personal information (subject to exceptions); (3) correct inaccuracies; (4) data portability; (5) opt out of “sale” or “sharing” of personal information for targeted/cross-context advertising; (6) limit use/disclosure of sensitive personal information where applicable; and (7) non-discrimination for exercising your rights. AGE RESTRICTION
You may not use or engage with the Platform if you are under thirteen (13) years of age. If you are between thirteen (13) and eighteen (18), you must have your parent’s or legal guardian’s permission. By using the Platform, you represent that you are not under 13, or that you have parental permission if between 13 and 18, and that you are permitted by applicable law to use the Platform.
DISPUTE RESOLUTION
Informal Resolution: Before taking formal action, email service@wmpeyewear.com with a written description of the dispute and your contact information and allow sixty (60) days for us to attempt an amicable resolution.
Mediation: If unresolved, the parties agree to endeavor to settle the dispute through mediation with a mutually agreed neutral mediator, sharing costs equally.
Binding Arbitration: If mediation is unsuccessful, either party may initiate binding arbitration administered by a recognized arbitral body mutually agreed upon by the parties. The arbitrator’s judgment may be entered in any court with jurisdiction. Each party bears its own costs and shares arbitrator costs unless otherwise ordered.
Class Action Waiver / Jury Waiver: TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. IF A DISPUTE PROCEEDS IN COURT, THE PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.
Opt-Out: IF YOU ARE A NEW WMP EYEWEAR USER, YOU CAN REJECT THE AGREEMENT TO ARBITRATE BY EMAILING AN OPT-OUT NOTICE TO SERVICE@WMPEYEWEAR.COM WITHIN THIRTY (30) DAYS AFTER THE DATE YOU FIRST ACCEPT THESE TERMS. IF YOU ARE NOT NEW, YOU HAVE THIRTY (30) DAYS AFTER POSTING OF NEW TERMS TO OPT OUT. Include your name, address, and the email(s) associated with your account(s), and a legible image of a valid driver’s license matching the account name.
Confidentiality: Except as required by law, neither a party nor the arbitrator may disclose the existence, content, or result of any arbitration without prior written consent of both parties, unless to protect or pursue a legal right.
Severability: If any term of this section is invalid or unenforceable, the remaining terms remain in effect.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles. Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the state or federal courts located in Arizona, and each party consents to jurisdiction and venue in such courts. If you access the Platform from outside the United States, you are responsible for compliance with local laws.
AMENDMENTS
We may modify, alter, or update these Terms at any time. Modifications are effective upon posting to the Platform (or as otherwise stated). While we may endeavor to notify users of significant changes, you are responsible for reviewing the Terms periodically. Your continued use following posting of revisions means you accept the changes. For substantial changes that materially diminish your rights or increase your responsibilities, we will provide more prominent notice (e.g., email or a prominent Platform notice) at least 30 days before effectiveness where feasible.
THIRD-PARTY LINKS
The Platform may contain links to third-party websites, services, or resources. These links are provided for convenience only and do not constitute endorsement. We do not control and are not responsible for third-party content, availability, or security. Accessing any third-party websites is at your own risk. We may terminate links at any time.
FORCE MAJEURE
We are not responsible for any delay or failure to perform due to events beyond our reasonable control, including acts of God; natural disasters; war; civil disturbances; government actions; embargoes or blockades; national or regional emergencies; labor disputes (excluding our own employees); utility failures; telecommunications disruptions; epidemics/pandemics; or other extraordinary events. If a force majeure event continues for more than 60 consecutive days, either party may terminate on 10 days’ written notice.
ASSIGNMENT
You may not assign, delegate, subcontract, or otherwise transfer your rights or obligations under these Terms without our prior written consent; any attempted transfer without consent is void. We may assign or transfer our rights and obligations (e.g., by merger, acquisition, reorganization, or sale of assets) without notice. These Terms bind and benefit successors and permitted assigns.
SEVERABILITY
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions remain in full force. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
ENTIRE AGREEMENT
These Terms (including policies incorporated by reference, such as our Privacy Policy and Help Center Return Policy) constitute the entire agreement between you and WMP Eyewear regarding the Platform and supersede all prior or contemporaneous communications and proposals (oral or written). Any modification must be in writing and signed by an authorized WMP Eyewear representative. Provisions that by their nature should survive termination do survive (e.g., IP, limitations of liability, indemnification, dispute resolution, governing law).

FLORIDA LAW (MOBILE MESSAGING COMPLIANCE)
We endeavor to comply with the Florida Telemarketing Act and Florida Do Not Call Act as applicable to Florida residents. For compliance purposes, you agree we may assume you are a Florida resident if, at opt-in, (1) your shipping address is in Florida or (2) your opt-in phone number uses a Florida area code, unless you notify us otherwise in writing. Messages sent in direct response to your requests (e.g., keyword replies, opt-in confirmations, HELP/STOP responses, shipping notifications) are not treated as “telephonic sales calls” for purposes of Florida Statutes Section 501 to the extent the law is otherwise relevant and applicable.
